US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment is without lawful basis.
"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.
The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling charges, he was detained in immigration detention.
In her order, the court noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The court challenge center on disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
